Bodies corporate often make the decision on the approval of the assignee for Management Rights. Essentially, this happens when the current caretaker decides to sell the management rights business to another entity who will take over from them. 

The Body Corporate has a final say in the approval process, but they can only refuse the assignment based on limited grounds. One of those factors is whether the purchaser has suitable experience in undertaking the contract and the duties therein. 

As our industry grows, buildings have become more involved, complex and generally larger in size. There are several risks for the Body Corporate making this approval of the purchaser, especially should they allow someone without experience to take over the building management. It is important for the body corporate to consider the assignment carefully and there is a duty of care for all parties involved. For example, negligence of carrying out the caretaking duties during an emergency could cause damage to property, bodily injury or even death.
